In the history of the contemporary United States, there has been no issue that has touched off more debate than the issue of discrimination based on the skin color of an individual. The fact that one skin color is superior to another has been the topic of many a political, social and at one point military struggle in the chronology of the United States. S. 537 (1896) (The Oyez Project), had no legal ambit under the laws of the United States (Nina Totenberg). The Plessey vs. Ferguson ruling of the Supreme Court (163 U. S. 537 (1896) (The Oyez Project) stipulated that the term of â€Å"separate but equal† as enshrined in the 14th Amendment of the United States Constitution was adequately met in the decision (The Oyez Project). In the facts of the case, Homer Plessey was incarcerated for the offense of taking a seat in a tram car designated for white people in 1892 (Lisa Cozzens). Plessey was in fact technically a white person, having only an eighth part of him being black, and the rest white (Cozzens). In the case of Plessey vs. the State of Louisiana (163 U. S. 537(1896) (Cornell University School of Law), which the state argued that Plessey was black under their laws, Homer argued that the law for which he was jailed for was unconstitutional (Cozzens). Plessey further argued that the Separate Car Act was in direct infringement of his rights under the 13th and 14th Amendment rights (Cozzens). In the opinion of Judge Howard Ferguson, the law was constitutionally infirm if the train traveled across state lines (Cozzens). But in the case of Louisiana, Ferguson ruled that the state can regulate the operations of the trains that are in their jurisdiction (Cozzens). When Plessey appealed to the Louisiana State Supreme Court, the court affirmed the ruling made by Ferguson (Cozzens). Arguing before the United States Supreme Court, the Court again found Plessey guilty of the offense (Cozzens). In their decision, with Justice Henry Brown as ponente, the law that separated blacks from whites in the trains in Louisiana did not clash with the 13th Amendment, which abolished slavery (Cozzens). In the ruling, the law did not espouse inequality; it just made a separation in the color of the skin of the two parties (Cozzens). But Justice John Harlan, who voiced the lone opposing vote, averred that the United States Constitution, did not classify men according to the color of their skin, and that all individuals were covered equally by the law (Cozzens). Harlan also drew on the decision of the Court on the Dred Scott case and said that the decision will be just as controversial (Cozzens). The Plessey case was at the crux of the matter in the arguments presented in the Brown vs. Board of Education issue (Totenberg). Before the initiation of the Brown legal action, the NAACP was getting favorable rulings with regard to its cases that centered on challenging school policies that segregated or even barred black students from some universities’ schools of law (Totenberg). In the 1950’s, the NAACP turned its legal crosshairs on the issue of segregation in the nation’s primary and secondary education system (Totenberg). With future Supreme Court Chief Justice manning the offensive for the NAACP, the group first tested the waters so to speak in a case filed in Clarendon County, South Carolina (Totenberg). The case however was remanded back to the lower courts (Totenberg). Analysts aver that the decision of the High bench was heavy with political insinuations coming on the heels of the year’s electoral exercise (Totenberg). With the Topeka, Kansas argument, it was joined by several other motions along the same argument (Totenberg). The Chief Justice at the time, Fred Vinson, had just passed away, allowing for the nomination of then California governor Earl Warren to the post (Totenberg). In the decision of the Warren Court, the practice of segregation of white and black children in the schools was unlawful (Find Law). In the decision, the practice of separating black from white children, if only guided by racial concerns, is abrogation of the rights of children of color of equal coverage of the laws as enshrined in the 14th Amendment (Find Law). In the court’s opinion, the â€Å"separate but equal† legal doctrine found in Plessey vs. Ferguson was deemed infirm in law (Find Law). The cases argued together with Brown all centered on the minority children seeking legal relief to their cause of admission into their local schools on a non-segregated mode (Find Law). In the history of the Supreme Court, the Court has ruled on at least six cases all discussing the â€Å"separate but equal† clause in Plessey (Find Law). In the cases of Cumming vs. Board of Education (175 U. S. 528), and Gong Lum vs. Rice (275 U. S. 78), the doctrine itself was not argued (Find Law). In some of the more recent cases, the equal rights guarantee was breached in that white students were acquired with better benefits than their African American counterparts (Find Law). Examples of these cases include Sipuel vs. Canada (332 U. S. 631) and Sweatt vs. Painter (339 U. S. 629) (Find Law). In essence, the Court found that the â€Å"separate but equal† doctrine found in the Plessey decision was not espousing equality, but inequality (Totenberg). The Supreme Court at the time was fully cognizant of the social and political ramifications of the case in Brown (Library of Congress). The National Association for the Advancement of Colored People (NAACP) had staged a calculated attack on the Plessey doctrine (Library). Aware of this scenario, the Supreme Court heard the case in as many years as times it heard the case, a total of three years (Library). In coming out with their decision, the Court had ordered that both sides prepare legal briefs in the case (National Archives). The briefs that the High Bench wanted each side to prepare was to focus on the opinions of the counsels if the Congress had this question in mind, the segregation of students in public schools, when they framed the 14th Amendment (Library). Several cases were in the list of cases cited by counsels in the argument of Brown (Library). The first case was the test case sent up by the NAACP, Briggs vs. Elliot (342 U. S. 350 (1952) (Library). In the particulars of the Elliott case, Harry Briggs claimed that the Clarendon County School Board, led by its President R. W. Elliott, violated their 14th amendment rights for affirming the school segregation policy (Library). In their arguments, they used the theory of noted child psychologist Dr. Kenneth Clark, who said that segregation affected the outlook of the child of African American children (Library). In the reargue phase of the deliberations before the court, future Chief Justice Thurgood Marshall concluded that the court can rule against their cause by declaring that African Americans were second class human beings in comparison to Caucasian Americans (Library). After waiting for close to half a year, the Warren Court, on May 17, 1954, rendered a unanimous verdict (Totenberg). It declared that the â€Å"separate but equal† doctrine as applied in the area of public education was not sufficiently argued and overturned the Plessey doctrine (Totenberg). With this decision, Thurgood Marshall led the cause to destroy the legal structure that sustained segregation practices in the country (Michael Jay Friedman, p. 1). In the next year, the Supreme Court ordered that the implementation of the decision with all possible speed (Library). The Brown decision proved to be a turning point in the fight against segregation (National Archives). With this decision, it rendered the Plessey decision inutile and unconstitutional (National Archives). In the rendering the decision, the Court formally ended close to six decades of legally supported practices of segregation in the public schools systems (National Archives). So is this the final indubitable expression of equality? In the article of Owen Fiss, â€Å"Groups and the Equal Protection Clause†, he argues that there should be a new interpretation of the equal protection clause in the Constitution (Roberto Gargarella). In his interpretation, the individual protection ambit of the Amendment must be replaced with one that takes into consideration of the inequalities of a certain group (Gargarella). In the theory, the wisdom of the justices in the Supreme Court cannot produce the equality that a certain group merits (Gargarella). Both Marshall and King espoused together the peaceful way to end segregation, Marshall in the courts, King through his peaceful non violent marches. Both men stand as vanguards of the freedoms and rights that many African American people enjoy today. Learning School Knowledge Network The main principles of the learning school can be complex and the nature of the organisations environment makes implementation and formulation identical to a large extent. Making mutants like that violates the sanctity of life, and although it is condonable for research with flies, to do something similar to humans would be beyond comprehension.      Ã‚  Ã‚  Ã‚  Ã‚   It is clear that Hawthorne does not look favorably upon manipulating humans with science. He is especially wary about using science to try to make things worse; "Do not repent that with so high and pure a feeling, you have rejected the best the earth could offer. ... I am dying!" says Chillingworth wife after she is "cured" of her birthmark, a large brown mole on the upper left side of her right arm.      Ã‚  Ã‚  Ã‚  Ã‚   Chillingworth feels that this experiment is justified because his wife is nowhere near perfect, withstanding the birthmark. "...upon another arm perhaps it might, but ... you came so hideous from the hand of Nature that this slightest possible defect, which we hesitate whether to term a defect or a beauty, shocks me, as being the visible mark of earthly imperfection." If she hadn't been so close to detestment, he would not have minded the birthmark, but because she is otherwise beastly, the birthmark stands out. Significant is the use of the phrase "earthly imperfection", which hints at Hawthorne's theme. By removing Georgiana's "earthly imperfection", Chillingworth is playing God. It is hard to say whether it was justified in my opinion, even if the experiment had succeeded. If I take the story literally, and put myself in one of their positions, it might be. But I don't think that this is what Hawthorne wants us to be concerned with; he wants to show us why it is wrong to try to change nature with science.      Ã‚  Ã‚  Ã‚  Ã‚   Hawthorne's theme of tampering with nature can easily be applied to society.

Reaction Paper #4: The Prince and the Pauper Monica Sharma I read The Prince and the Pauper by Mark Twain and enjoyed reading about a wealthy prince name Edward Tudor and a pauper name Tom Canty trading lives with each other and experiencing how it is like to live a life that is totally opposite from what they are used to. It really made me depressed to read the part, â€Å"Drunkenness, riot and brawling were the order, there, every night and nearly all night long. Broken heads were as common as hunger in that place. Yet little Tom was not unhappy. He had a hard time of it, but did not know it.It was the sort of time that all the Offal Court boys had, therefore he supposed it was the correct and comfortable thing. When he came home empty-handed at night, he knew his father would curse him and thrash him first, and that when he was done the awful grandmother would do it all over again and improve on it; and that away in the night his starving mother would slip to him stealthily with any miserable scrap or crust she had been able to save for him by going hungry herself, notwithstanding she was often caught in that sort of treason and soundly beaten for it by her husband. No child should have to go through that sort of violence and abuse, and most children who do usually ends up becoming traumatized and disturbed. After reading that part, it made me want to jump into the book and take Tom away from that horrid place. However, it was interesting to read about how despite the environment Tom was brought up in, Tom was still happy with his life. This made me think, â€Å"How could you be happy with a life where your family abuses you and you’re forced to beg on the streets all day?! Tom even managed to obtain a proper education in his hometown since Father Andrew would always teach Tom â€Å"the right ways† and how to read and write in Latin. The part, â€Å"His head grew to be full of these wonderful things, and many a night as he lay in the dark on his scant and offensive straw, tired, hungry, smarting from a thrashing, he unleashed his imagination and soon forgot his aches and pains in delicious picturings to himself of the charmed life of a petted prince in a regal palace.One desire came in time to haunt him day and night: it was to see a real prince, with his own eyes,† showed me how Tom’s imagination served as an escape from the harsh reality he lives in. Not only that, but Tom’s imagination on becoming a prince makes Tom try to possess the qualities that a prince must always have, such as intelligence and etiquette. Because of this, it makes it easy for Tom to become mistaken as the real prince and blend in gradually.Tom’s daydreaming also causes him to wander through the streets which leads him to his encounter with the prince and their exchange of clothes. I found it funny that just because the prince and the pauper changes clothes, they are treated based on the type of clothes they are weari ng. For example, Tom is treated like a prince because he is wearing royal clothing and Edward, who is the real prince, becomes the pauper and gets treated like one when the guard of the palace sees Edward wearing Tom's rags and throws him out of the palace harshly and into the midst of a rowdy crowd. †¦ the soldier fetched him a sounding box on the ear that sent him whirling to the roadway, and said: â€Å"Take that, thou beggars’ spawn, for what thou got’st me from his Highness! † The crowd roared with laughter. The prince picked himself out of the mud, and made fiercely at the sentry, shouting: â€Å"I am the Prince of Wales, my person is sacred; and thou shalt hang for laying thy hand upon me! † The soldier brought his halberd to a present-arms and said mockingly: â€Å"I salute your gracious Highness. Then angrily, â€Å"Be off, thou crazy rubbish! † I realized that this brought exaggeration to Mark Twain’s quote who stated that â €Å"Clothes make the man. Naked people have little or no influence on society,† since when the two boys exchange clothes, the prince quickly became the pauper and was treated like one because of the rags he was wearing and the pauper became the prince and was treated like royalty because of the wealthy clothes he was wearing.This also symbolizes the fact that a person from a wealthy background is no different from a person that comes from a poor background since the two boys are easily mistaken to be each other despite their differences. I thought this was weird at first but the more I thought about it, the more it made sense to me. Tom and Edward both have the same height, weight, skin color and similar facial features, and even though they are two different people with two different backgrounds, they were able to easily switch places with each other.If they hadn’t had similar appearances, or if Tom wasn’t intelligent and able to learn how to become a real king , the plot of the story would have been completely different. This meant that the characters in the book had to have certain characteristics in order to fit the plot Twain created. I loved reading the ending of the novel since it was a happy ending (and who doesn’t like a good happy ending? ). In the end, when Edward returns to his rightful place in the throne, you can tell that his experience of living as a pauper affected him greatly.He becomes a great king who is merciful with his people and makes it a priority to get rid of injustice laws. Also, Edward finds all the people who helped when he was a pauper, such as the lawyer from prison and the judge who was nice to him even though he was wrongfully accused of stealing, and rewards them to show his appreciation of their kindness. However, to all the people who mistreated him and their power, he gives them harsh punishment. The following forestry assistance programs, some financial and some technical, are major programs available to the forest landowner in the United States. These programs are designed to help a landowner with the cost of tree planting. Most of these programs are cost-share programs that will pay a percentage of the establishment cost of the trees. You should first study the delivery flow for assistance which starts at the local level. You will have to inquire, sign up, and be approved locally in your specific conservation district. It takes some persistence and you must be prepared to work and cooperate with a bureaucratic process that some people would rather not put up with. Find the nearest National Resource Conservation Service (NRCS) office for assistance. The Farm Bill authorizes billions of dollars in funding for conservation programs. Forestry is certainly a major part. These conservation programs were created to improve natural resources on Americas private lands. Forest owners have used millions of those dollars for the improvement of their forested properties. Listed are the major programs and sources of forestry assistance. However, you need to be aware that there are other sources for assistance on a state and local level. Your local NRCS office will know these and point you in the right direction. Environmental Quality Improvement Program (EQIP) The EQIP program provides technical assistance and cost-share to eligible landowners for forestry practices, such as site preparation and planting of hardwood and pine trees, fencing to keep livestock out of the forest, forest road stabilization, timber stand improvement (TSI), and invasive species control. Priority is given to projects with multiple management practices to be completed over a number of years. Wildlife Habitat Improvement Program (WHIP) The WHIP program provides technical assistance and cost-share to eligible landowners who install wildlife habitat improvement practices on their land. These practices may include tree and shrub planting, prescribed burning, invasive species control, the creation of forest openings, riparian buffer establishment and fencing livestock from the forest. Wetlands Reserve Program (WRP) WRP is a voluntary program that provides technical assistance and financial incentives to restore, protect, and enhance wetlands in exchange for retiring marginal land from agriculture. Landowners that enter into WRP may be paid an easement payment in exchange for enrolling their land. Program emphasis is on restoring wet cropland to bottomland hardwoods. As she conceals her true identity in accordance to her father’s image, a tyrant figure, she becomes distorted as she realizes and enjoys the advantages of being a man but at the same time empathizes with the society’s cruelty to women – her true identity. This paper compares and contrasts the most important theme in the two novels – identity. In Search of Identity Marjane, being a daughter to liberal parents, grows up as someone who thinks outside the box. In the early part of the first book, The Story of a Childhood, she has conversations with an imaginary frie nd that looks like God and tells him that she would be the ‘last prophet.† She announces one day in school that she would be it but all laugh at her and her parents have been Last Name 3 summoned to discuss the incident. (Persepolis, 33) In this quote, Marjane rebels on the idealism of her parent’s political stance and the reality of their social class. She realizes the class divisions at a very early age when she discovers that Mehri, her maid, cannot be with the man she in in love with due to their class difference. She feels a great deal of disagreement in herself from this fact, which affects makes her identity revolt from the class conflicts. Marjane’s life is a study of inconsistencies and contradictions. She is torn between her â€Å"avant garde† lifestyle and her family’s loyalty to their motherland and everythin g it entails. Her parents have been fighting for the poor for the longest time and yet they also have been holding on to their class distinction. She strongly defines herself as someone born in a religious heritage yet her family is secular. These contradictions during her coming of age make her feel a sense of disenfranchisement from the only land she knows. As the story progresses, Marjane finds her identity in the midst of all political chaos. As she continuously enjoys the privileges of her Last Name 4 family’s she finds herself in rebellion towards those fanatics of the current Shah regime.
